Please read these Terms of Service ("Terms") carefully before using the swimsationalswimschool.com website (the "Site") or the services offered by Swimsational Swim School ("Swimsational," "we," "us," or "our").

By accessing or using our Site or services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Site or services.

1. Acceptance of Terms

By accessing or using our Site, enrolling in our programs, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are enrolling a minor in our programs, you represent that you are the parent or legal guardian of that minor and accept these Terms on their behalf.

2. Description of Services

Swimsational Swim School provides aquatic education and related services including, but not limited to:

  • Infant swim classes (ages 5 months and up)
  • Group swim lessons for children and adults
  • Private swim lessons
  • Swim team programs (year-round practice and Shockwaves competitive team)
  • Summer swim camps and clinics
  • Birthday party hosting
  • Water aerobics classes

Services are provided at our facility located at 878 N Beglis Pkwy, Sulphur, LA 70663. We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

3. Registration and Enrollment

Registration and enrollment for our programs are managed through JackRabbit Class, a third-party class management platform. By registering through JackRabbit Class, you agree to their terms of service and privacy policy in addition to these Terms.

You are responsible for providing accurate and complete information during registration. You agree to promptly update your information if it changes. You must provide accurate health and medical information relevant to your child's participation in aquatic activities.

Enrollment constitutes a commitment. Our year-round lesson program uses a continuous enrollment model — lessons continue until you submit a withdrawal form on the 1st of your final month. Failure to submit a withdrawal form may result in continued billing.

4. Birthday Party Bookings

Birthday party booking requests submitted through our website are inquiries only and do not constitute a confirmed reservation. Bookings are not guaranteed until you receive written confirmation from Swimsational. We reserve the right to decline any booking request based on availability, capacity, or other factors.

Party deposits, if required, are non-refundable. Cancellations must be made at least 48 hours in advance to avoid forfeiture of any deposit. Party packages and pricing are subject to change without notice.

5. Payments, Cancellations, and Refunds

Lesson fees and program costs are as listed on our website or provided at the time of registration. All payments are processed through JackRabbit Class or other authorized payment methods.

Missed lessons: We do not provide refunds or credits for individual missed lessons. Makeup sessions may be available based on instructor availability and scheduling.

Summer camps and clinics: No refunds are issued for missed camp or clinic days. We will attempt to offer makeup opportunities in other weeks if spots are available.

Withdrawal: To withdraw from continuous enrollment programs, you must submit a withdrawal form on or before the 1st of your intended final month. Refunds for partial months are not provided.

6. Assumption of Risk and Liability Waiver

Swimming and aquatic activities involve inherent risks, including but not limited to: drowning, near-drowning, physical injury, muscle strain, slip-and-fall injuries, and exposure to waterborne illness. By enrolling in our programs or attending our facility, you voluntarily assume all risks associated with participation in aquatic activities.

To the fullest extent permitted by Louisiana law, you agree to release, hold harmless, and indemnify Swimsational Swim School, its owners, employees, instructors, agents, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses arising from or related to:

  • Participation in any Swimsational program, class, or event
  • Use of our facility and equipment
  • Any injury, illness, or property damage occurring on our premises

This waiver applies to you and any minor child enrolled in our programs for whom you are the parent or legal guardian.

Important: Additional liability waivers may be required at the time of enrollment or before participation in specific programs. You agree to sign all required waivers as a condition of participation.

7. Facility Rules and Conduct

All participants, parents, and visitors are expected to follow facility rules and conduct themselves in a respectful and safe manner. Swimsational reserves the right to remove any individual from the facility for disruptive, dangerous, or inappropriate behavior. No refunds will be issued for removal due to conduct violations.

8. Content Ownership and Intellectual Property

All content on this Site — including text, graphics, logos, images, videos, and software — is the property of Swimsational Swim School or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any content from this Site without our prior written consent, except for personal, non-commercial use such as printing a page for your own reference.

9. Photography and Media

Swimsational may photograph or video record lessons, events, and activities for use in marketing materials, social media, and our website. By enrolling in our programs, you consent to the use of your or your child's likeness in such materials unless you provide written notice opting out. You may opt out at any time by contacting us in writing.

10. Third-Party Links

Our Site may contain links to third-party websites and services, including JackRabbit Class for enrollment and payment processing. These links are provided for your convenience only. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites.

Your use of third-party websites is at your own risk and subject to the terms and conditions of those sites.

11. Disclaimer of Warranties

Our Site and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by Louisiana law, Swimsational disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our Site will be uninterrupted, error-free, or free of harmful components, or that any content will be accurate or complete.

12. Limitation of Liability

To the fullest extent permitted by Louisiana law, Swimsational Swim School shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of or inability to use our Site or services.

13. Modifications to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Changes become effective immediately upon posting to this page. The "Last updated" date at the top of this page indicates when these Terms were last revised.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Calcasieu Parish, Louisiana.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.
